Article 3.2: Order of PRODUCTS

Article 3.3: Legal guarantees
The BUYER benefits from the legal guarantee of conformity of the Consumer Code and the legal guarantee against defects of the Civil Code. He has 14 days to act from the delivery of the goods. If this period is exceeded for MISSPANTIES to receive the package for an exchange or a refund, unfortunately MISSPANTIES will not be able to proceed at the request of the BUYER if the period has expired.

Upon receipt of the PRODUCTS and finding of non-compliance or hidden defect MISSPANTIES undertakes, at the choice of the PURCHASER, either to exchange the PRODUCT for an identical PRODUCT or of equivalent quality and price depending on stock availability, or to reimburse the price of the PRODUCT within a maximum period of 14 days following the PURCHASER's request.
Article 4: Order
An ORDER is deemed to have been placed on the SITE and the general conditions of sale accepted once the BUYER has validated his payment. The data recorded by MISSPANTIES and the secure payment provider constitute proof of the nature, content and date of the ORDER.

Article 5: Price
The selling price of the Product is that in force on the day of the Order.

Article 6: payment
Payment for Products purchased from MISSPANTIES via the Site is required in full at the time of the Order.

The MISSPANTIES e-Gift Card is valid for 1 year from the date of purchase, only on the MISS-PANTIES.com site
How to use the MISSPANTIES e-Gift Card:

2. Choose the MISSPANTIES products you wish to purchase and add them to your shopping cart.
3. Go to your basket once your selection has been made.
4. At the payment step, enter the unique code of your MISSPANTIES E-gift card by choosing the payment method by E-gift card.
- The amount of your MISSPANTIES E-gift card will then be deducted from your Order. If the balance on your E-card is not sufficient to make all of your purchases, simply complete using one of the other available payment methods. From the date of purchase, the beneficiary has one year to use their MISSPANTIES e-gift card. If the value of the E-card is greater than the amount of the purchase, the difference will remain available on the E-card after the same period of use. Beyond the period of one year, the amount available on the card will be lost by the beneficiary; it cannot be refunded or used on a next purchase. The sum will remain acquired by MISSPANTIES.
MISSPANTIES does not cover costs relating to payments from countries outside France.
MISSPANTIES reserves the right to suspend any management of ORDERS and any delivery in the event of non-payment or refusal of authorization of payment by credit card from officially accredited and usual Internet organizations.
MISSPANTIES reserves the right to refuse to honor an ORDER from a BUYER who has not paid for all or part of a previous ORDER or with whom a payment dispute remains.
MISSPANTIES reserves the right to refuse to honor an ORDER from a BUYER by E-GIFT CARD who cannot justify the origin of the E-Card in his possession.
MISSPANTIES cannot be held responsible for any embezzlement or fraudulent use of any means of payment that has not been detected by the verification procedure. The BUYER guarantees to MISSPANTIES that he has the necessary authorizations to use the payment method he has chosen for his ORDER.
Any fraudulent use of the bank card cannot give rise to reimbursement by MISSPANTIES.
Article 7: Securing of Payments
Purchases made by the BUYER are secure. When the BUYER places his ORDER online, it is on the MISSPANTIES servers. When the BUYER makes payment for his ORDER, it switches to the secure servers of the MISSPANTIES partner: STRIPE, SHOPIFY PAYEMENT, PAYPAL.
Payment data is exchanged in an encrypted manner using the protocol defined by the approved payment provider involved in banking transactions carried out on the site. The SELLER cannot be held responsible for any fraudulent use of the means of payment used.
Article 8: Shipping & Delivery
Delivery is limited to Metropolitan France, Corsica, Overseas (only Réunion, Martinique, Guadeloupe), Belgium, Luxembourg, Italy, Spain, Switzerland, Germany, United States and Canada.
MISSPANTIES undertakes to ship the ORDER as soon as possible from receipt of payment. Delivery will be made within an average period indicated in DELIVERY & RETURNS following 1 to 14 working days depending on the choice of delivery method made by the PURCHASER and the country of destination, and in any event within a maximum period of 30 days from the day following that of the transmission of the ORDER. During Private Sales, during product launch or restocking, during holidays, sales or Black Friday, the preparation and shipping times for the Order may be extended.
Any erroneous or missing mention in the delivery address and the identity of the PURCHASER releases MISSPANTIES from responsibility for the delivery. MISSPANTIES is not responsible for delivery delays caused by the indication of an incorrect or incomplete address.
In the event of an ORDER not collected by the BUYER from a relay point or in front of his home due to absence, within 15 days, it will be returned to MISSPANTIES. Upon receipt, MISSPANTIES will not be able to reimburse the amount of the PRODUCTS of the ORDER, the sum of money will be lost for negligence on the part of the BUYER and will remain with MISSPANTIES. MISSPANTIES declines all responsibility for delivery delays caused by the absence of the recipient of the package or his non-withdrawal within the period provided for this purpose.
It is specified that in the event of unavailability of the relay point initially chosen by the PURCHASER, in particular during a summer holiday period or during high activity, MISSPANTIES may deliver the ORDER to another relay point.
Upon receipt of the ORDER, the BUYER is required:
To formulate all reservations and complaints with the transport provider or to refuse the package if it is likely to have been opened or damaged; AND report these incidents to Customer Service;
Complaints must be made by the BUYER without delay and no later than 3 working days from receipt of the ORDER.
Failing this, the ORDER is deemed to be delivered in good condition and MISSPANTIES is released from all liability.
Each delivery is deemed to have been made as soon as the carrier has made the Products available to the CUSTOMER or to a third party designated by him, as evidenced by the control system used by the carrier. Unless proven otherwise, no dispute relating to the delivery itself will be possible if the package appears to have been delivered, the carrier's computer system being proof.
Article 9: Withdrawal
With the exception of the specific case of non-compliance of PRODUCTS compared to the ORDER, there is no exchange of PRODUCT possible. If the BUYER changes his mind and wishes to exchange an ordered PRODUCT for a new PRODUCT, he must, under his right of withdrawal, return the PRODUCT. This will be refunded but not exchanged. In the case of a gift card purchased on the MISS-PANTIES.com Site, the PURCHASER has a period of 14 (fourteen) days from the confirmation of his Order to exercise his right of withdrawal, subject nevertheless that the gift card has not been used in whole or in part before the expiry of this period. Indeed, in this case no right of withdrawal or refund in any form whatsoever is provided.
In the event of exercise of his right of withdrawal, the BUYER must express to MISSPANTIES Customer Service his clear desire to withdraw within the aforementioned maximum period of 14 days. The products must be returned in a condition suitable for re-marketing (complete products and in perfect condition with their original packaging, accessories, instructions) within fourteen (14) days from the date on which the PURCHASER has RECEIVED his package. The PURCHASER must also inform MISSPANTIES Customer Service of his intention to withdraw and at the latest within fourteen (14) days of the date of receipt. Returns of products returned after this deadline will not be accepted. Open, damaged, soiled or incomplete products are not taken back for reasons of hygiene, safety and health protection..
The refund of the product (s) returned from the Order will be made no later than 14 days from receipt of the returned product (s). will however be NON-REFUNDABLE by MISSPANTIES and as regards the costs of return they are the sole responsibility of the PURCHASER.
If the amount of the BUYER's original Order has enabled him to obtain an advantage (free shipping, gifts), reimbursement of returned products will be possible subject to the return of the advantages..
If the total amount of the returned items causes the amount of the initial Order to fall below the threshold giving access to free shipping, said shipping costs will then be deducted from the amount of its reimbursement.

MISSPANTIES does not accept parcels or letters sent collectively.
Article 10: Liability
